Marcelino, a former PDEA official and known anti-drug advocate, claimed he was in the area also on anti-drug operation.

The DOJ had initially junked the case against him and Yan, but later reversed the resolution.

The Public Attorney's Office (PAO), meantime, urged a reconsideration of the issuance of the warrant, and moved for the lifting of the same.
